Notice of Sale - Table of Contents

INSTRUCTIONS FOR BIDDING ON MORTGAGE FORECLOSURES

Please report to Room #1049 on the day of sale and let the clerk know the case you plan to bid on. The clerk will have a sheet for you to sign in. At that time you must show the clerk your 5% before bidding on said property. See below for explanation of 5%.

Per F.S. 28.24(13) all final bids are subjected to a Registry of Court Fee. Clerk’s registry fees must be paid by separate cashier’s check. Registry fees are based on three percent (3%) of the first five hundred dollars ($500) and one and a half percent (1.5%) of every additional one hundred dollars ($100) of the bid.

When the representative for the Plaintiff appears for the sale, the clerk will proceed with the sale at the front steps of the courthouse. At the time of sale, if you are the successful bidder, you will need to pay at least 5% of your bid in a cashier’s check only. Within two (2) hours from the time of sale, the remainder of the bid and Clerk’s Fees must be paid. Effective March 25th, 2013 the Clerk’s Office will not accept cashier’s checks in excess of the amount of the successful bid. Checks for the bid must be payable to Clerk of Circuit Court for the exact amount owed. All clerk registry fees must be in the exact amount and paid via a separate check.

Any interested party has 10 days from the day of sale to object to the Certificate of Title. On the 11th day after the sale, if there is no objection filed, a Certificate of Title will be issued.

At the time the certificate of title is to be issued, you as the successful bidder must provide Doc Stamp fees (.70 per $100.00 of bid amount) to the Clerk’s Office.

Notice – During the Clay County Clerk of the Court’s transition to conducting foreclosure sales online there will be some foreclosure sales that will be conducted at the Clay County Courthouse and NOT online through Clay.RealForeclose.com. Notice – Effective December 1, 2016, the Clay County Clerk’s Office will no longer accept trust checks or business checks for the deposits or final payments in foreclosure sales or tax deed sales. The approved forms of payment as of December 1, 2016 will be as follows:

  • Online Foreclosure Sales: Cash, Cashier’s Check or Wire Transfer (for deposits only)
  • Foreclosure Sales Conducted at the Clay County Courthouse: Cash or Cashier’s Check
  • Tax Deed Sales: Cash or Cashier’s Check
